Best Buy Black Friday VIP Contest Promotion Official Rules

  1. NO PURCHASE NECESSARY. PURCHASE WILL NOT ENHANCE CHANCES OF WINNING. Open and offered only to legal residents of the 50 United States and District of Columbia who are 18 years or older (except residents of Alabama and Nebraska, who must be 19 or older), and for the RZPS Contest Period defined below, who are Best Buy Reward Zone program Premier Silver members in good standing as of October 26, 2009. Void in Puerto Rico and where prohibited. Employees, directors and agents of Best Buy Stores, L.P. ("Sponsor"), Skybridge Marketing Group ("Administrator"), and their parent entities, subsidiaries and affiliated companies, advertising, promotion, or production agencies, Web masters and Web suppliers (and their respective IRS dependents, immediate family members [children, spouse, parents, siblings] and individuals residing in their same household) are not eligible to participate. Void where prohibited. By participating, entrants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to this Promotion. There are two (2) separate contest periods throughout the Promotion: (1) eligible Reward Zone program Premier Silver Members who are members as of October 26, 2009 may enter the Contest of the Promotion starting October 27, 2009 and ending November 20, 2009 ("RZPS Contest Period"); and (2) eligible members of the general public may enter the Contest of the Promotion starting November 2, 2009 ending November 20, 2009 ("Public Contest Period").
  2. HOW TO ENTER: To enter, (1) eligible Reward Zone program Premier Silver members may visit www.BestBuyVIPContest.com ("Web site") from 12:00:01 a.m. Central Time ("CT") on October 27, 2009, through 11:59:59 p.m. CT on November 20, 2009; and (2) eligible members of the general public may visit www.BestBuyVIPContest.com from 12:00:01 a.m. CT on November 2, 2009 through 11:59:59 p.m. CT on November 20, 2009, and then follow the entry instructions for registering on the Web site, consisting of (i) completing and submitting the online Contest entry form (Reward Zone program Premier Silver members must provide their member I.D.); (ii) selecting the Participating Store you will be nearest to on Black Friday, November 27, 2009, from among the list of Participating Stores provided on the Contest entry form (prize only includes mileage within a 20 mile radius of the Participating Store; if a participant does not reside within a 20 mile radius of the Participating Store they have selected, participant will be responsible for personal transportation to a designated pick-up location within such 20 mile radius at participant’s sole expense); and (iii) submitting an essay which includes no more than 250 words telling us what you are most excited about this Black Friday (collectively, "Submission"). LIMIT OF ONE (1) ENTRY PER PERSON. If you have forgotten your Reward Zone program member I.D. number or password, you may request assistance by calling 1-888-BEST BUY. Proof of submission is not proof of receipt. Administrator’s computer will be the official time clock for the Contest. Any attempt at email or other Internet entry is void. Any attempt by any person to obtain more than the stated number of entries by using multiple/different email accounts or any other methods will void all of that person’s entries and that person will be disqualified.

    To be eligible, your Submission must: (1) be your own original work that has not been submitted to any other third party, including another contest; (2) not exceed 250 words; (3) be owned by you; (4) be non-confidential; (5) have been legally created; (6) not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any person or entity (collectively, a "Qualifying Submission"). Submissions that contain text that is deemed to be lewd or profane; contain material that violates or infringes on another’s rights, including privacy, publicity or intellectual property; material that is hateful or defamatory; material that promotes bigotry, racism, or harm against a group or individual or promotes discrimination; or material that is unlawful or in violation of or contrary to the laws or regulations in any state, will be disqualified as determined solely by Sponsor. Submissions must be received by 11:59:59 p.m. CT on November 20, 2009 to eligible. Posting of a Submission on the Web site is not verification that the Submission is a Qualifying Submission. All Submissions will be reviewed for content before being judged. Submissions containing such prohibited content and/or otherwise deemed by Sponsor, in its sole discretion, to be inappropriate will be disqualified. Sponsor makes the final determination as to what Submissions are eligible to take part in the Contest of the Promotion. By entering, entrant agrees that the Submission will not be acknowledged or returned. By submitting a Submission, each entrant warrants and represents that it is an original Submission created by the entrant and grants Sponsor the perpetual, unlimited and irrevocable right to post, publish, adapt, edit, make derivative works and/or otherwise use the Submission in any manner, including copyright, and in any media now known or hereafter developed.

CONTEST JUDGING CRITERIA: All Qualifying Submissions for each Participating Store will be judged by a qualified judging panel on or about November 23, 2009, based on the following judging criteria and percentages: Creativity and Originality (50%); relevance to the stated focus of the contest (25%); Readability (25%). The Qualifying Submission with the highest overall score from each Participating Store will be deemed the Grand Prize winner for that Participating Store. In the event of a tie between any two Finalists, the Finalist with the highest score in the Creativity and Originality criteria will be deemed the Grand Prize winner for that Participating Store. Limit one (1) prize per person/household. Winners will be notified by telephone, express and/or e-mail on or about November 24, 2009.
  4. PRIZES: Twenty-Five (25) Grand Prizes (One (1) Grand Prize winner per Participating Store): A Black Friday Store Event, consisting of: limousine transportation to and from the Participating Store and the winner’s designated pick-up location on November 27, 2009 for winner and three (3) guests including special VIP treatment, one (1) Insignia 2.3 MP Digital Camcorder to videotape the Grand Prize winning experience, one (1) $1,000.00 Best Buy Gift Card, and for Reward Zone program Premier Silver members only, $149.99 towards Geek Squad installation of winner’s purchases, awarded in the form of a Geek Squad Gift Card (good for installation services only). PLEASE NOTE: Pick-up location for Grand Prize winner and winner’s guests for the Event must be within twenty (20) miles from the Participating Store. If Grand Prize winner does not reside within such 20 mile radius, winner and guests will be responsible, at their sole expense, for any personal transportation to a pick-up location within such 20 mile radius. Pick-up location is subject to Sponsor’s approval. Parent/guardian approval will be required for guests that are minors in their jurisdiction of primary residence. If winner cannot participate in the Black Friday Event as stated, prize will be forfeited in its entirety and may be awarded to an alternate winner, time permitting. Approximate Retail Value ("ARV") $2,149.99/each for winners who are Reward Zone program Premier Silver members; and $2,000.00/each for winners who are members of the general public. Total ARV of all Grand Prizes is $50,000.00 – $53,749.75 (actual total ARV will depend on whether winners are Reward Zone program Premier Silver members or members of the general public). By accepting the Grand Prize, winners understand and agree that Sponsor will exchange the Insignia 2.3MP Digital Camcorder containing footage of the winner’s experience upon the close of the Event for a new Insignia 2.3MP Digital Camcorder so that Sponsor may use, in its sole discretion, the video footage shot by winners for promotional purposes. All minors must be accompanied by a parent/legal guardian at all times. No responsibility is assumed for any canceled, rescheduled, unavailable or postponed Black Friday events, in whole or in part, in which case the event portion of the prize will be forfeited in its entirety and the Sponsor is responsible only for providing the digital camcorder and gift card portions of the prize which will constitute full satisfaction of Sponsor’s prize obligation to winner with no substitute or additional compensation awarded. Winners are solely responsible for all applicable taxes, insurance, travel-related expenses not set forth herein (including but not limited to meals, gratuities, personal charges and incidental hotel expenses), store purchases (other than purchases made with gift card prize) and other expenses, which may be required for the enjoyment and use of the prize. Winners may not substitute, assign or transfer prizes, or redeem prizes for cash, but Sponsor reserves the right to substitute prize with a prize of equal or greater value should the advertised prize become unavailable. Gift cards are subject to terms contained on gift card. Prizes will not be fulfilled outside the 50 U.S./D.C.
  5. CONDITIONS OF PARTICIPATION: Participants agree (a) that Sponsor, and its parent entity, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Promotion or any Promotion related activity, including but not limited to any travel to, or attendance at, the prize event; or for any printing, production, typographical, human or other error in the printing, offering or announcement of any prize; and (b) except where legally prohibited, winners grant (and agree to confirm they grant in writing) permission for Sponsor and those acting under its authority to use his/her name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide and on the Internet and/or World Wide Web, without notice, review or approval. Prize winners may be required to complete, sign and return an Affidavit of Eligibility, a Liability Release and where lawful, a Publicity Release within 24 hours of attempted notification, to be sent via facsimile to Administrator. If documents are not returned on a timely basis, or if prize is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited and awarded to an alternate winner, time permitting. Guest of winner, if any, will be required to sign and return a liability/publicity release prior to attending the event. If winner's guest is a minor, the minor must be accompanied at all times by a parent/legal guardian who must sign and return all required documentation. Taxes on prizes are solely the winner’s responsibility. By participating in this Promotion, you acknowledge and agree that Sponsor may collect the personal information submitted by you, and use the information pursuant to Sponsor’s privacy policy available on-line at www.bestbuy.com or by calling 1-888-BEST BUY.
  6. LIMITATIONS ON LIABILITY: Neither Sponsor nor its respective agencies are responsible for illegible, lost, late, damaged, incomplete, unintelligible, non-delivered, misdirected, or stolen e-mail, or prize redemption forms; or for lost, interrupted or unavailable network, server, satellite, Internet Service Provider (ISP), Web site, telephone, or other connections, availability or accessibility; or for miscommunications, failed computer, telephone, satellite, or cable transmissions, lines, or technical failure; or for jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or for any other errors of any kind, whether human, mechanical, electronic or network; or for the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. Persons who tamper with or abuse any aspect of the Promotion or Web site, as solely determined by the Sponsor, will be disqualified, and Sponsor reserves the right to terminate such entrant’s eligibility. Entries generated by a robotic, programmed, script, macro or other automated means will be disqualified. Neither Sponsor nor its agencies are responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Promotion or downloading materials from or use of the Web site. Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend or terminate the Promotion, and select winners from Qualifying Submissions received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion, and assumes no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, technical failure, theft or destruction, or unauthorized use to the Web site. In the event of a dispute as to ownership of a winning Qualifying Submission from a Reward Zone program Premier Silver member, the owner of the Reward Zone program Premier Silver membership card used to enter online, as indicated in Sponsor’s records, will be deemed the winner and must comply with these Official Rules. In the event of a dispute regarding online Qualifying Submissions from members of the general public received from multiple users having the same email account, the authorized subscriber of the e-mail account at the time of entry used to enter will be deemed to be the entrant and must comply with these Official Rules. Sponsor is not responsible for outdated or incorrect Reward Zone program membership data. Authorized account subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning email addresses.

All suits or claims brought in connection with this Contest must be brought in a state or federal court in Minneapolis, Minnesota.
